Litigation

Sterne Kessler represents innovators in complex intellectual property disputes involving patents, trademarks, trade secrets, copyrights, and related commercial issues. Our IP litigation attorneys combine trial strategy, technical fluency, and deep knowledge of intellectual property to help clients enforce and defend valuable IP rights and manage risk throughout the life of a dispute. Our team delivers results—no matter the venue, technology, or legal issue, we are a formidable litigation practice built on a foundation of technical excellence.

We litigate cases in federal district courts, before the U.S. International Trade Commission (ITC), and appeals before the U.S. Court of Appeals for the Federal Circuit. In addition, we collaborate closely with our award-winning Patent Trial and Appeal Board (PTAB) Trials Practice on inter partes review and post-grant review proceedings as well as ex parte reexaminations before the U.S. Patent and Trademark Office. Our team is skilled at coordinating actions across multiple venues when a multi-venue strategy can be favorable for our clients.

A Formidable Patent Litigation Practice Built on Technical Excellence

Over the last five years, Sterne Kessler has served as litigation counsel for both patent owners and accused infringers in more than 150 patent cases across 27 jurisdictions in federal district court. We are also one of the top five most active firms at the U.S. Court of Appeals for the Federal Circuit, and we are among the top 10% of most active firms at the U.S. International Trade Commission (ITC) in that same time frame.

Sterne Kessler’s technical bench is our strategic advantage. We leverage our team of 100+ advanced degrees, including 60+ Ph.D.s., in science and engineering disciplines to quickly grasp complex technologies. We build litigation teams around the legal and technology experience that each case demands and as a result, we can effectively explain complex technology and IP concepts to judges in a compelling way that increases the likelihood of a successful outcome.
