Adil B. Moghal, Ph.D. is an associate in Sterne Kessler’s Biotechnology & Chemical Practice Group. His practice includes global prosecution of biotechnology patent applications and patent litigation on behalf of patent owners and defendants or challengers in United States district courts and the USPTO Patent Trial and Appeal Board (PTAB).

Adil has a diverse skill set, including patent application drafting and prosecution both domestically and in numerous foreign jurisdictions, providing written legal opinions as to non-infringement of client competitor patents, preparing offensive and defensive strategies for infringement and patent validity in district court, and providing high-level strategy to balance infringement and validity positions. On the litigation side, Adil regularly works directly with experts and clients, including preparing expert report drafts, preparing experts for deposition and trial testimony, and coordinating infringement testing. Adil is a key strategist on multiple district court and PTAB inter partes matters. On the prosecution side, Adil’s litigation skills translate to working with clients small and large to obtain patents with a keen eye to potential competitor challenges, and his work has led to Orange Book listed and Purple Book listable patents. Further, Adil’s deep knowledge of patent prosecution allows him to spot issues in litigation, providing a strategic edge against litigation opponents.

Prior to working at Sterne Kessler, Adil’s doctoral research focused on the kinetic and catalytic quality control mechanisms used by aminoacyl-tRNA synthetases to modulate the rate of errors in ribosomal protein synthesis. His work included a collaboration with Amgen to identify the source of phenylalanine misincorporation at tyrosine codons in therapeutic monoclonal antibodies produced in Chinese hamster ovary cells, which is of high importance for quality control in therapeutic antibody manufacturing. His technical skills include protein expression and purification, RNA biology, including tRNA biology, microbiology, and enzyme kinetics. Adil worked at The Ohio State University’s Technology Commercialization Office in graduate school and law school and understands the university’s perspective in commercializing inventions.
