Sterne Kessler Director Daniel Block was featured in Thomson Reuters’ Changemakers series, highlighting the recent partnership between Sterne Kessler and Thomson Reuters to develop the Patent Claim Eligibility Analyzer.

The Patent Claim Eligibility Analyzer, an AI-powered workflow within CoCounsel Legal, was developed to assess Section 101 patent eligibility risk, one of the most unpredictable areas in IP law. Block and the Sterne Kessler AI team’s idea for the tool started with a hypothesis — the best way to predict how a court will rule on a Section 101 challenge is to find how closely prior case claims resemble the claims at issue.

The tool fundamentally changes workflow for IP attorneys with claim-specific starting points, reduced manual research, litigation-ready arguments, and a head start on brief writing. It’s already been tested in recent litigation, as Block explains “We have a client in the media space that was sued on a patent. We used the tool to respond with a motion to dismiss without even asking for an extension — something that has never happened at any other point in my career. That speed showed the plaintiff how aggressive our client was willing to be, and our client received a very favorable outcome.”
