Much like AI technology itself, the AI patent landscape is evolving at a rapid pace—challenging patent owners and practitioners with evolving guidance and case law. In this first session, we discussed the current state of AI patent prosecution and shared practical strategies to prepare stronger AI applications.

Drawing on recent USPTO trends and insights from the Federal Circuit’s recent AI decision in Recentive Analytics, Inc. v. Fox Corp., we examined how key developments are shaping patent drafting practices and offered forward-looking strategies in anticipation of where AI law is heading. The discussion also went beyond software to explore the growing impact of AI in other technical fields, such as medical devices.
