This morning, the Supreme Court denied certiorari in the closely-watched patent eligibility case of American Axle v. Neapco. There were no noted dissents and no statements respecting the denial of certiorari. The denial means that the Court will not be providing clarity on subject-matter eligibility in the near future. For now, then, the task of grappling with this contentious issue remains with the lower courts, Congress, and the U.S. Patent and Trademark Office.
