This annual report provides summaries of notable 2023 decisions issued by the U.S. Court of Appeals for the Federal Circuit in intellectual property cases. Featured topics include claim construction, obviousness, and the requirements of the Administrative Procedure Act. This year’s edition expands coverage beyond patent law to include trademark cases as well. Additionally, the report discusses the Federal Circuit’s currently pending en banc case in LKQ v. General Motors and includes an analysis of the U.S. Supreme Court’s latest foray into patent law—last year’s Amgen v. Sanofi decision on enablement.

In the coming weeks, the firm will publish three companion reports covering notable 2023 PTAB decisions, cases at the ITC, and recent developments specific to design patents in the U.S. and internationally.
