Three Recent PTAB Reforms Offer Peek Into Trump-Era IP Policymaking

Director Lestin Kenton spoke to Intellectual Asset Management (IAM) about recent changes to how the PTAB will handle institution decisions for inter partes review and post-grant review proceedings, including the new memo providing guidance for PTAB judges for Fintiv discretionary denials.

“It could be business as usual at the PTAB, since there were no rule changes, but things could fall to the other side of the pendulum, where you see an uptick of discretionary denials,” suggested Kenton.
