Monica Riva Talley, director and head of the firm’s Trademark & Brand Protection Practice, spoke to Law360 on this year’s top trademark cases and decisions.

In the Ninth Circuit’s Yuga Labs Inc. v. Ryder Ripps et al. case from this year, the opinion demonstrated the narrowing of the “Rogers” test from the 2023 Supreme Court decision in Jack Daniel’s Properties Inc. v. VIP Products LLC. Talley commented on what this means for other trademark cases stating, “After the VIP products case, it’s clear the Rogers test is not a get-out-of-jail-free card anymore.”
