Sterne, Kessler, Goldstein & Fox earned a patent infringement victory for client Sweegen, Inc. regarding a natural non-caloric sweetener used in food and drinks. The U.S. District Court for the Central District of California granted defendant Sweegen’s motion for Summary Judgment of patent invalidity, holding all claims of both patents invalid for inadequate written description under 35 U.S.C. § 112, and further holding certain claims of each patent invalid for claiming ineligible subject matter under 35 U.S.C. § 101.
