The annual year-in-review report was edited by Director Michael Joffre, Ph.D. and authored by Directors Kristina Caggiano Kelly, William H. Milliken, Anna G. Phillips, R. Now in its seventh year, this annual report provides summaries and analysis of the most significant decisions issued last year by the U.S. Court of Appeals for the Federal Circuit involving cases on appeal from the U.S. Patent and Trademark Office’s Patent Trial and Appeal Board (PTAB) and the U.S. International Trade Commission (ITC). Topics of the featured intellectual property cases include exclusion of expert testimony, the ITC’s ability to enforce consent orders, estoppel by inter partes review (IPR) final written decisions, standing to challenge PTAB decisions on appeal, obviousness in light of overlapping ranges in the prior art, and settlements of IPRs before the PTAB.
