Pro-Patent Policies and AI Replicas: 2026 Predictions

Sterne Kessler Director, Daniel Yonan, spoke to Managing IP on the trends in intellectual property law from the past year and the outlook for 2026.

Yonan said, “A pro-patent change is first being seen across the Patent Trial and Appeal Board but is also spilling into the International Trade Commission and the district court as they shift toward being more pro-patentee and value the rights that come with having a patent.”

He also mentioned the firm’s artificial intelligence (AI) initiatives and its own tools, commenting that the firm’s tools are advanced compared to the market and clients are interested in them for their own business use.
