Washington, D.C. (March 18, 2025) – Sterne, Kessler, Goldstein & Fox obtained a significant victory for pro bono client, Military-Veterans Advocacy. The firm successfully persuaded a Federal Circuit panel to set aside a provision of a U.S. Department of Veterans Affairs (VA) rule governing access to the VA’s electronic benefits management system. The challenged provision permitted the VA to inspect, at any time and without notice, any computer equipment used by veteran representatives to obtain access and the location of any such equipment.
In a precedential opinion, the court determined that the challenged provision exceeded the VA’s statutory authority and was not the product of reasoned decision-making.
