Sterne Kessler’s chemical products team helps clients leverage intellectual property (IP) to increase shareholder value for a diverse range of companies in the chemical industry.

Our diverse clients in this sector include companies developing new chemical compounds, products based on chemistry and materials science, chemical processes, polymers and polymer processing technology, and the methods of synthesizing, purifying, and using chemicals.

Our chemical products team prepares and prosecutes patents both domestically in the United States and in collaboration with foreign associates around the world. In addition, the team provides risk assessments and formal opinions regarding freedom-to-operate, validity, and infringement—helping to determine how and when to defend or enforce patents, the likelihood of infringing other’s patents, and strategies to avoid potential infringement. The team also litigates patents and trademarks in district courts, at the U.S. International Trade Commission, at the Patent Trial and Appeal Board of the USPTO, and in appeals to the Federal Circuit.

The team is adept in supporting commercialization of complex technologies and helping clients to monetize their inventions. Our advice and counsel around commercialization and transactions includes:
