			<title>SKGF Associate Achieves Pro Bono Success on Behalf of U.S. Veteran</title>

			<description><![CDATA[<p align="justify">Graham Phero recently achieved success in a pro bono matter on behalf of a U.S. Army veteran suffering from a hearing loss disability as a result of his service.&nbsp; Mr. Phero&rsquo;s client had been denied increased benefits at both the VA Regional Office and at the Board of Veterans&rsquo; Appeals.&nbsp; The veteran then appealed his claim to the U.S. Court of Appeals for Veterans Claims.&nbsp; Mr. Phero represented him before this court and argued against the Board&rsquo;s decision.&nbsp; Counsel for the Office of Veteran Affairs did not dispute Mr. Phero's arguments and agreed to a joint motion for remand to the Board of Veterans&rsquo; Appeals.&nbsp; The veteran is now able to present additional evidence and it is likely that his application for increased benefits will be granted.</p>]]></description>

			<title>USPTO Publishes Request for Comments and Notice of Public Hearings on Genetic Diagnostic Testing </title>

			<description><![CDATA[<p>The United States Patent and Trademark Office is interested in gathering information on the genetic diagnostic testing for purposes of preparing a report on the subject as required by the America Invents Act. To assist in gathering this information, the USPTO invites the public to provide comments and to attend public hearings addressing genetic diagnostic testing.</p><p>The USPTO will hold two public hearings in support of the genetic testing study. The first public hearing will be held on Thursday, February 16, 2012, beginning at 9 a.m., Eastern Standard Time (EST), and ending at 4 p.m., EST, in Alexandria, Virginia. The second public hearing will be held on Friday, March 9, 2012, beginning at 9 a.m., Pacific Standard Time (PST), and ending at 4 p.m., PST, in San Diego, California.</p><p>Those wishing to present oral testimony at either hearing must request an opportunity to do so in writing no later than February 8, 2012. Requests to testify should indicate the following: (1) The name of the person wishing to testify; (2) the person's contact information (telephone number and email address); (3) the organization(s) the person represents, if any; (4) an indication of the amount of time needed for the testimony; and (5) a preliminary written copy of the testimony. The USPTO asks for a preliminary written copy of the testimony in order to better prepare for pre-scheduled witness testimony. Requests to testify must be submitted by email to Saurabh Vishnubhakat at <a href="mailto:saurabh.vishnubhakat@uspto.gov">saurabh.vishnubhakat@uspto.gov</a>. 			<description><![CDATA[<p align="justify">The United States Patent and Trademark Office (Office) is proposing to amend the rules of practice in patent cases to implement the supplemental examination provisions of the Leahy-Smith America Invents Act. The supplemental examination provisions permit a patent owner to request supplemental examination of a patent by the Office to consider, reconsider, or correct information believed to be relevant to the patent. These provisions could assist the patent owner in addressing certain challenges to the enforceability of the patent during litigation. The Office is also proposing to adjust the fee for filing a request for ex parte reexamination and to set a fee for petitions filed in ex parte and inter partes reexamination proceedings to more accurately reflect the cost of these processes. 			<description><![CDATA[<p>The United States Patent and Trademark Office has published three Notices of Proposed Rulemaking as listed below. </p><p>1.&nbsp; <a href="http://www.gpo.gov/fdsys/pkg/FR-2012-01-05/pdf/2011-33813.pdf" target="_blank">Changes To Implement Miscellaneous Post Patent Provisions of the Leahy-Smith America Invents Act.</a>&nbsp; </p><p align="justify">Brief Summary: <br /><br />SUPPLEMENTARY INFORMATION: Section 6 of the Leahy-Smith America Invents&nbsp;Act replaces the current <em>inter partes</em> reexamination proceedings with <em>inter partes</em> review proceedings, and creates new post grant review proceedings. See Public Law 112-29, 125 Stat. 284 (2011). Section 6 of the Leahy-Smith America Invents Act also provides for an estoppel that may attach with respect to <em>ex parte</em> reexamination based on an <em>inter partes</em> review or post grant review proceeding. The Office is proposing to revise the rules of practice in title 37 of the Code of Federal Regulations (CFR) to implement these post-patent provisions, along with changes in nomenclature pertaining to the renaming of the ``Board of Patent Appeals and Interferences'' as the ``Patent Trial and Appeal Board'' and the replacement of references to interference proceedings with references to derivation proceedings. The post grant review,<em> inter partes</em> review, and derivation provisions of sections 3 and 6 of the Leahy-Smith America Invents Act will be implemented by separate rulemakings.</p><p><br />2.&nbsp;&nbsp;&nbsp;<a href="http://www.gpo.gov/fdsys/pkg/FR-2012-01-05/pdf/2011-33811.pdf" target="_blank">Changes To Implement the Preissuance Submissions by Third Parties Provision of the Leahy-Smith America Invents Act<br /></a></p><p align="justify">Brief Summary:<br /><br />This provision provides a mechanism for third parties to contribute to the quality of issued patents by submitting to the Office, for consideration and inclusion in the record of patent applications, any patents, published patent applications, or other printed publications of potential relevance to the examination of the applications. A preissuance submission may be made in any non-provisional utility, design, and plant&nbsp;application, as well as in any continuing or reissue application. A third-party preissuance submission must include a concise description of the asserted relevance of each document submitted and be submitted within a certain statutorily specified time period. The third party must submit a fee as prescribed by the Director and a statement that the submission complies with all of the statutory requirements. The third-party preissuance submission provision of the Leahy-Smith America Invents Act is effective on September 16, 2012, and applies to any application filed before, on, or after September 16, 2012.</p><p><br />3.&nbsp; <a href="http://www.gpo.gov/fdsys/pkg/FR-2012-01-05/pdf/2011-33814.pdf" target="_blank">Implementation of Statute of Limitations Provisions for Office Disciplinary Proceedings<br /></a></p><p align="justify">Brief Summary:<br /><br />The Leahy-Smith America Invents Act (AIA) requires that disciplinary proceedings be commenced not later than the earlier of the date that is 10 years after the date on which the misconduct forming the basis of the proceeding occurred, or one year from the date on which the misconduct forming the basis of the proceeding was made known to an officer or employee of the United States Patent and Trademark Office (Office or USPTO), as prescribed in the regulations governing disciplinary proceedings. The Office initiates disciplinary proceedings via three types of disciplinary complaints: complaints predicated on the receipt of a probable cause determination from the Committee on Discipline; complaints seeking reciprocal discipline; and complaints seeking interim suspension based on a serious crime conviction. This notice proposes that the one-year statute of limitations commences, with respect to complaints predicated on the receipt of a probable cause determination from the Committee on Discipline, the date on which the Director, Office of Enrollment and Discipline (OED Director) receives from the practitioner a complete, written response to a request for information and evidence; with respect to complaints based on reciprocal discipline, the date on which the OED Director receives a certified copy of the record or order regarding the practitioner being publicly censured, publicly reprimanded, subjected to probation, disbarred, suspended, or disciplinarily disqualified; and, with respect to complaints for interim suspension based on a serious crime conviction, the date on which the OED Director receives a certified copy of the record, docket entry, or judgment demonstrating that the practitioner has been convicted of a serious crime.</p>]]></description>

			<title>USPTO Proposes Revision of AIPA Patent Term Adjustment Provisions</title>

			<description><![CDATA[<p>The USPTO has published a notice of proposed rulemaking in which it proposes to adjust how patent term adjustment (PTA) is calculated with regard to BPAI review. Click <a href="http://www.gpo.gov/fdsys/pkg/FR-2011-12-28/pdf/2011-33150.pdf" target="_blank">here</a> for more information.</p><p>The&nbsp;USPTO is proposing to change the rules of practice to indicate that the period of appellate review under the patent term adjustment provisions of the AIPA begins when jurisdiction over the application passes to the BPAI rather than the date on which a notice of appeal to the BPAI is filed. The Office recently published the final rule (eff. date Jan 23, 2012) concerning practice before the BPAI in ex parte appeals and defined that jurisdiction of the appeal passes to the BPAI at the earlier of the filing of the reply brief or upon the expiration of the time in which to file a reply brief. See Rules Of Practice Before the Board of Patent Appeals and Interferences in Ex Parte Appeals 76 FR 72270, 72273 (November 22, 2011).</p><p>Accordingly, for purposes of calculating patent term adjustment based upon appellate review, the impact of the rule change would be to reduce the amount of patent term adjustment awarded for successful appeal under&nbsp; 35 USC 154(b)(1)(C)(iii). However, the impact may be offset by potentially increasing the amount of patent term adjustment awarded for failing to issue the patent within three years of the actual filing date in the United States under 35 USC 154(b)(1)(B). The patent term adjustment award for the three year provision may increase when the examiner reopens prosecution after a notice of appeal is filed (e.g., following a pre-appeal conference or an appeal conference) and the patent issues thereafter, because the period of time between the filing of the notice of appeal and the examiner's reopening of prosecution would no longer be deducted under 35 USC 154(b)(1)(B)(ii).<br />&nbsp;<br />Written comments must be received on or before January 27, 2012. No public hearing will be held.</p>]]></description>

			<description><![CDATA[<p align="justify">On September 16, 2011, the Leahy-Smith America Invents Act was signed into law by President Obama. This law brings sweeping change to the current U.S. patent system, including transforming the current first-to-invent system into a first-inventor-to-file system. The first-to-file provisions of the Act take effect on March 16, 2013. These provisions substantially overhaul what acts are considered to be &quot;prior art&quot; and what acts are excepted. This presentation will provide an in-depth review of the new scope of prior art under the America Invents Act of 2011, focusing on what forms of disclosure prior to the effective filing date of a patent application will prevent the applicant from obtaining a patent in the United States. Case studies will be presented to illustrate the new prior art provisions, their exceptions, and how the new provisions compare to the existing prior art standards. The presentation will touch on how these new prior art provisions compare to the prior art rules of other developed countries having first-to-file systems.</p>]]></description>

To view the full presentation, download the PDF below.</p><p align="justify">Abstract: In an effort to promote the development and commercialization of biobased technologies that conserve natural resources or reduce negative environmental impact, such as the sustainable, cost- and eco-efficient production of chemicals, materials, consumer goods, and alternative energy, patent offices in the U.S. and around the world are adopting strategies to expedite the examination of patent applications pertaining to such &ldquo;green&rdquo; technologies.&nbsp; Since implementation of the U.S. Patent and Trademark Office's Green Technology Pilot Program on December 8, 2009, over 500 patents have issued under the Program.&nbsp; Given that the average pendency of patent applications examined in turn is about 35 months, companies should carefully consider taking advantage of this new accelerated examination procedure to quickly bring their green technologies to market.&nbsp; This presentation will outline the requirements, advantages and disadvantages and current statistics for accelerated examination under the USPTO's Pilot Program and will identify and briefly discuss similar initiatives worldwide.</p>]]></description>

			<description><![CDATA[<p>On September 16, 2011, President Obama signed the Leahy-Smith America Invents Act (H.R. 1249) into law. One major aim of the reform legislation is to establish the United States Patent and Trademark Office (USPTO) as an alternative forum to U.S. district courts for vetting the validity of issued U.S. patents. These sections modify existing practice and provide entirely new structures and legal bases for deciding patentability questions at the USPTO. </p><p>Given the scope of these changes, this webinar will address how the Act as a whole opens the door wider for patent litigation at the USPTO. This includes a closer look at: </p><ul><li>The new agency-level decision-making body created by the Act, called the Patent Trial and Appeal Board (PTAB), and its composition, role, and procedures.</li><li>The four new (or recast) grounds for vetting patentability at the USPTO on behalf of patent owners or third-party challengers: post-grant review, inter partes review, supplemental examination, and the original ex parte reexamination. </li><li>Various strategic issues raised by the America Invents Act as it aims to move more patentability decisions to the USPTO and at the same time make them more timely and efficient.</li></ul>]]></description>

			<description><![CDATA[<p align="justify">IPO is presenting a series of webinars on the landmark Leahy-Smith America Invents Act, which was signed into law on September 16, 2011.</p><p align="justify">The first webinar will look at Post Grant Review (PGR) and Inter Partes Review/Reexamination (IPR) and the impact these provisions will have on patent litigation. Although new laws associated with PGR and IPR will not go into effect until September 16, 2012, it will be critical to understand the new laws as soon as possible.&nbsp; In particular, estoppels, stays, and filing deadlines will shape patent litigation strategy.</p><p align="justify">Moreover, requests for traditional IPR will be permitted until September 16, 2012; however, the standard for granting such a request has been changed from the substantial new question (&ldquo;SNQ&rdquo;) standard to a &ldquo;reasonable likelihood that the requester would prevail with respect to at least one of the claims challenged in the request.&rdquo;&nbsp; The U.S. Patent and Trademark Office has already implemented this change in the rules of practice.</p><p align="justify"><strong>Speakers:</strong></p><p align="justify">&bull;&nbsp;Kevin Rhodes, 3M Innovative Properties Co.<br />&bull;&nbsp;Jon Wright, Sterne, Kessler, Goldstein &amp; Fox, PLLC<br />&bull;&nbsp;Charles Miller, Dickstein Shapiro LLP</p>]]></description>

			<title>Gene Patents:  Myriad Genetics and Beyond</title>

			<description><![CDATA[<p align="justify">Last year, a federal District Court in New York ruled, in Association for <em>Molecular Pathology et al. v. U.S. Patent and Trademark Office et al.</em>, that isolated human genes are not patentable subject matter. 			<description><![CDATA[<span><p align="justify">Through a series of recent decisions, the Federal Circuit has demonstrated that it will vigorously scrutinize the basis for patent damages awards. All parties involved in patent litigation will benefit from a deeper understanding of the analytical framework used by the Federal Circuit to review patent damages awards.</p><p align="justify">This webinar will discuss the current framework for patent damages resulting from the Federal Circuit's interpretation of the landmark Georgia-Pacific decision. Three important recent Federal Circuit decisions, Lucent Technologies, Inc. v. Gateway, Inc., 580 F.3d 1301 (Fed. Cir. 2009), i4i Ltd. v. Microsoft Corp., 589 F.3d 1246 (Fed. Cir. 2009), and ResQNet.com, Inc. v. Lansa, Inc., 2010 U.S. App. LEXIS 2453 (Fed. Cir. 2010), demonstrate that there has been a shift in the Federal Circuit's scrutiny of damages awards. These decisions provide discrete lessons for both patent plaintiffs and patent defendants and will be discussed in detail in the webinar.</p></span>]]></description>

			<description><![CDATA[<p align="justify">Rob Sterne and Jon Wright continued the Sterne, Kessler, Goldstein &amp; Fox's law school presentation series on Tuesday, April 14 at George Mason Law School in Arlington, Virginia.&nbsp; Sterne and Wright presented an interactive talk on reexamination and concurrent patent litigation, entitled &quot;Reexamination and Concurrent Patent Litigation: The Most Significant Development in Patent Enforcement in the Last Five Years.&quot;&nbsp;</p><p align="justify">The team spoke to an engaged audience of George Mason intellectual property students and other outside attendees.&nbsp; Sterne and Wright's hour-long discussion focused on the rapidly developing area of patent reexamination within the United States.&nbsp; The talk's material was taken from Sterne and Wright's ongoing reexam cases, as well as their roles in authoring Reexamination Practice with Concurrent District Court Litigation or Section 337 USITC Investigations, a go-to guide on reexams, published by The Sedona Conference.&nbsp;</p><p align="justify">The presentation concluded in a question and answer session with the audience.&nbsp; Students and attendees asked pointed questions to Sterne and Wright about current reexam cases, SKGF's micro website <a href="http://www.reexamcenter.com/">www.reexamcenter.com</a>, and the future impact of patent reexamination in intellectual property law.&nbsp; Jon Wright, a George Mason Law alumni, commented that &quot;it was great to get back to my alma mater, George Mason, and talk to the current students. &nbsp;They were engaged through the whole presentation and threw us some very astute questions at the end. &nbsp;Rob and I appreciated their energy and we wish we could have stayed a bit longer.&quot;&nbsp; </p><p align="justify">&nbsp;</p>]]></description>

			<description><![CDATA[<p align="justify">Ms. Holoubek spoke on the topic of &quot;Software Patents in a post-Bilski World.&quot;&nbsp; <a href="http://www.skgf.com/software">Software</a> and <a href="http://www.skgf.com/businessmethods">business method</a> patents offer a way for tech companies to recoup their investments and protect the innovative work of their engineers. &nbsp;However, these types of patents have recently come under attack by the U.S. Patent and Trademark Office since the recent Federal Circuit decision In re Bilski. &nbsp;Essentially, some patent applications are being rejected either because the software methods (a) are not tied to another class (such as an apparatus) or (b) do not transform matter. This presentation will provide a brief introduction to software patents, explain what the Bilski test means for software inventions, and provide some guidelines for the type of information that needs to be included in a software patent application to pass the Bilski test.</p>]]></description>
